Terms and Conditions

For the purposes of these Terms and Conditions as well as of any Contract entered into by Internet-Marketing-One.Com and the Client, all services performed by Internet-Marketing-One.Com shall be collectively known as "Services". Further, any website work, idea, product, material, or other information developed or produced in whole or in part by Internet-Marketing-One.Com in connection with these Services shall be known collectively as "Work Product".
 
Because every project is unique, the client will be furnished a written proposal (based on our defined services) for each website optimization project, specifying the work to be done. We will never guarantee to place a client's web site in a specific position on a specific page for any particular search engine.

General Terms and Conditions
 
1. Proposals: A signed proposal and/or purchase order shall be required for all work. The signed proposal shall become the Contract between all parties.

2. Agreement: The signed Contract contains the entire agreement of the parties, and there shall be no other promises or conditions in any other agreement, whether oral or written. Any changes to the terms and/or conditions specified in the Contract must be made in writing and agreed upon by both parties before those changes are initiated.

3. Payment Terms: Specific fees and payment terms will be included by Internet-Marketing-One.Com in each proposal. In general, however, a 100% deposit shall be required when proposal is accepted. Terms to arrange for hourly to be paid monthly can be arranged. We often agree to a 50% deposit followed by the balance being paid 6 months later.

4. Payment Options: Payment must be made in U.S. funds by certified check or money order only, drawn on a U.S. Bank. We also accept Visa and Mastercard through Paypal. Make certified check or money order payments to: Internet-Marketing-One.Com, PO Box 264, Galesburg, MI 49053-0264. Make credit card Paypal payments to: One@Internet-Marketing-One.Com.

5. Rush Jobs: Not available due to search engines 30-45 day crawl updates.

6. Ownership: Once payment for Work Product is received in full all Work Product becomes the property of Client. Until payment in full is received, all Work Product remains the property of Internet-Marketing-One.Com. Internet-Marketing-One.Com reserves the right to retain or delete any web site Work Product that has not been paid for.

7. Confidentiality: Internet-Marketing-One.Com agrees to maintain the confidentiality of all source materials supplied by Client.

8. Revisions: Revisions are included in the original fees or in the maintenance agreement, provided they do not result from changes in the original terms of the project made after Work Product has been submitted.

9. Guarantee and refund: Internet-Marketing-One.Com guarantees your web site's position will improve for the keyword/phrase and search engine it has been optimized for, at the end of our optimization process (usually 1 year). If we fail to improve your web site's position the client will get a full refund. We will never guarantee to place a client's web site in a specific position on a specific page for any particular search engine.

10. Non-Acceptance: If, after all work is complete the Client chooses not to accept Work Product completed by Internet-Marketing-One.Com, the following provisions shall apply:
      a. Internet-Marketing-One.Com will republish the original website html code or delete the entire new website for the client;
      b. The Client agrees to keep no copies of said Work Product, which includes created html code, links contacts established, etc.
      c. All completed Work Product shall remain the property of Internet-Marketing-One.Com.
      d. Any past payments for services rendered shall be nonrefundable except as specified in provision number 8, above; however, there will be no additional charges for services rendered and the Contract will be considered terminated with no further liability on the part of either party.
      e. Any payments made for future work or maintenance shall be fully refunded to the client.

11. Non-Payment: Client agrees to reimburse Internet-Marketing-One.Com for all legal fees and all additional costs related to collection for non-payment.

12. Disclaimer: Internet-Marketing-One.Com reserves the right to decline any project for which, in its judgment, it cannot meet the required specifications. Further, Internet-Marketing-One.Com reserves the right to decline any project that includes what it deems to be objectionable materials. Internet-Marketing-One.Com reserves sole discretion in these matters.

13. Internet-Marketing-One.Com promises that we will not accept any other clients for the specific keywords/phrases selected for optimization by this client, as long as this client is an active client, paying for annually maintenance.
